1. Disclaimer and Limited
Warranty
1.1 mysmartcad.com liability for breach of these terms and
conditions shall not exceed in any event the total price of the
service or Products ordered by You under any one purchase
UNDER NO CIRCUMSTANCES SHALL
MYSMARTCAD.COM BE LIABLE TO YOU FOR ANY AMOUNT EXCEEDING THE TOTAL
AMOUNT PAID.
1.2 mysmartcad.com shall not be liable for any delay or non-delivery
of any Products or Services under this Agreement which is caused
by any event or circumstances beyond its reasonable control.
2. Ordering, Availability and Delivery
2 .1 mysmartcad.com reserves the right to accept or decline Your
order for any reason.
2 .2 mysmartcad.com reserves the right to change its prices at any
time without prior notice.
2 .3 Any dates for delivery quoted by mysmartcad.com shall be estimates
only and mysmartcad.com shall not be liable for any loss arising
from the failure to deliver any Products by any date quoted.
2 .4 mysmartcad.com reserves the right, without liability or prior
notice, to revise or cease to make available any service or Products.
3. Credit Card Transactions
All payments made for services and Products purchased from mysmartcad.com
shall be made by credit card and handled by directly by Paypal.
mysmartcad.com will not receive directly or store any credit card
information in respect to any transactions made through our website
and shall not be responsible for any leakage or personal credit
card information submitted by You in purchasing any Product or service.
Payment is subject to the approval of the applicable financial institution
issuing the credit card to You and mysmartcad.com shall not be liable
if such financial institution refuses to accept or honour Your payment.
4 . Typographical Errors
In the event that any prices for Products or Services provided on
the On-Line Shop are declared by mysmartcad.com as being listed
incorrectly as a result of a typographical error or otherwise, mysmartcad.com
reserves the right to refuse or cancel any orders placed against
the declared incorrect price, regardless of whether or not the order
and transaction has already taken place. In circumstances where
Your credit card has already been charged the incorrect price, mysmartcad.com
will immediately arrange to credit Your credit card against the
incorrect amount and process a new order at the correct price.

We have no responsibility for any Information or other services

of the Services from time to time.

of the Services for operational reasons at any time but will endeavour
to give You as much notice as is reasonably practical before doing
so.
5 .6 mysmartcad.com may provide or mysmartcad.com's contractual
partners may provide links to other web sites or resources. mysmartcad.com
neither accept responsibility for them nor endorses their Content.
6 . Intellectual Property Rights and Trademarks
6 .1 All intellectual property rights, Documentation, Content or
other information or material accessed, supplied or available on
mysmartcad.com, shall remain the property of mysmartcad.com. The
use or purchase of any Products from mysmartcad.com does not imply
any right of ownership to the intellectual property rights contained
therein.
6 .2 You agree to comply with the terms of any agreement reasonably
required by the owners of any intellectual property rights in such
Program(s), software, Documentation, Content or other information
or material, relating to the use of the material and protection
of any vested rights.
7. Termination
Unless otherwise specified in writing by mysmartcad.com, you will
not receive any refund for payments already made by you as of the
date of termination, and, you may incur additional fees. If termination
of this Agreement is due to your default hereunder, you shall bear
all costs of such termination, including any reasonable costs mysmartcad.com
incurs in closing your account. You agree to pay any and all costs
incurred by mysmartcad.com in enforcing your compliance with this
Section. Upon termination, you shall destroy any copy of the materials,
including modified copies supplied to you hereunder and referenced
herein. You agree that upon termination or discontinuance for any
reason, we may delete all information related to you on mysmartcad.com
service, if applicable. In addition to the terms set forth herein,
certain mysmartcad.com services may have additional terms regarding
termination, which are set forth in the applicable Schedule.
8. Changes to the Agreement
mysmartcad.com reserves the right to change these terms and conditions
without prior notice at any time, at mysmartcad.com's sole discretion.
